Acceptance of these Terms

These Terms of Use ("Terms") govern your access to and use of my-roadster.us and any related newsletter or club communications (together, the "Site"), operated by My Roadster ("we," "us" or "our"). By using the Site, you agree to these Terms and to our Privacy Policy and Cookie Policy. If you do not agree, do not use the Site.

Eligibility

You may browse the Site at any age with the involvement of a parent or guardian, but you must be at least 16 years old to join the club or newsletter. By joining, you confirm that you meet this requirement.

Informational content only

Articles, checklists, route descriptions and other content on the Site are provided for general informational and entertainment purposes. They are not professional mechanical, legal, financial or safety advice. Vehicles differ — always follow your manufacturer's instructions and consult a qualified professional before performing maintenance or making purchase decisions.

Driving safety and route information

• Always obey traffic laws, posted speed limits and the instructions of law enforcement.
• Never use the Site or any device in a way that distracts you while driving.
• Route lengths, seasons and descriptions are approximate and may be out of date. Roads can close, change or become hazardous without notice. Check official sources, such as state departments of transportation and the National Park Service, before you travel.
• You are solely responsible for your vehicle, your driving and your decisions. We do not organize, supervise or insure any drive, meetup or event, and participation in any informal gathering is at your own risk.

Newsletter and communications

If you join the club, you agree to receive emails from us. You can unsubscribe at any time using the link in any email. We may also send non-promotional messages related to your requests.

Your submissions and feedback

If you send us messages, photos, route suggestions or other material ("Submissions"), you confirm that you have the right to do so and that the Submission does not violate anyone's rights or any law. You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, edit and publish your Submission in connection with the Site, with credit where reasonably practical. Do not send confidential or sensitive information. Feedback about the Site may be used without obligation to you.

Acceptable use

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms;
• Attempt to gain unauthorized access to the Site, its servers or any related systems;
• Introduce malware or interfere with the Site's operation or security;
• Scrape, crawl or harvest content or personal data by automated means, except for standard search-engine indexing;
• Submit false information, impersonate another person or send spam;
• Use Site content to train machine-learning or AI models without our written permission.

Intellectual property

The Site and its content — including text, original illustrations, graphics, logos, layout and code — are owned by My Roadster or its licensors and are protected by U.S. and international copyright, trademark and other laws. You may view and print pages for personal, non-commercial use. Any other copying, distribution, modification or commercial use requires our prior written permission.

Independence and third-party trademarks

My Roadster is an independent publication. We are not affiliated with, sponsored by or endorsed by any vehicle manufacturer, dealer or brand. "Roadster" is used in its generic sense to describe a style of open two-seat car. Any third-party names or marks that may appear belong to their respective owners and are used for identification only. The vehicle illustrations on the Site are original drawings of a generic roadster and do not depict any specific product.

Copyright complaints

If you believe material on the Site infringes your copyright, send a notice to [email protected] that includes: identification of the work and the allegedly infringing material, its location on the Site, your contact information, a statement of good-faith belief that the use is unauthorized, a statement under penalty of perjury that your notice is accurate and that you are authorized to act, and your physical or electronic signature.

Third-party links

The Site may contain links to third-party websites. We do not control and are not responsible for their content, policies or practices. Accessing them is at your own risk.

Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT ANY INFORMATION IS COMPLETE OR CURRENT.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MY ROADSTER AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE OR GOODWILL, OR FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM YOUR USE OF OR RELIANCE ON THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify and hold harmless My Roadster and its contributors from any claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your Submissions or your misuse of the Site.

Governing law and disputes

These Terms are governed by the laws of the State of [State] and applicable U.S. federal law, without regard to conflict-of-law rules. Before filing a claim, you agree to try to resolve the dispute informally by emailing [email protected]; we will try to resolve it within 60 days. Any claim that is not resolved informally shall be brought exclusively in the state or federal courts located in [State], and you consent to their jurisdiction. Either party may bring an individual claim in small-claims court where eligible.

Changes and termination

We may update these Terms from time to time by posting a revised version with a new "Last updated" date. Material changes will be highlighted on the Site. Continued use after changes take effect means you accept them. We may suspend or discontinue the Site, or your access to it, at any time.

Miscellaneous

These Terms, together with our Privacy and Cookie Policies, are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a business transfer.
